Committee of Ministers of CoE adopts resolution in case of arrested Azerbaijani opposition politician
The Committee of Ministers of the Council of Europe adopted an interim resolution (Interim Resolution CM/ResDH(2015)43) in the case Ilgar Mammadov versus Azerbaijan on its first “human rights” meeting for 2015, Azerbaijani independent TV channel Meydan TV reports.
It is stated in the resolution that the violations found in that case, and in particular that of Article 18 in conjunction with Article 5 of the Convention for the Protection of Human Rights and Fundamental Freedoms, challenge the foundation of the criminal proceedings against the applicant who is an opposition politician. The Committee expressed its very serious concern about the fact that the applicant is still detained despite the obligation of Azerbaijan to comply with the judgment of the European Court of Human Rights.
The Committee reiterated with insistence its call to the authorities in Azerbaijan to ensure without further delay the applicant’s release and to adopt the other measures necessary to erase the consequences of the violations established. In the Resolution the Committee also called upon the Azerbaijani authorities to provide, without delay, concrete and comprehensive information on the measures taken and/or planned to avoid that criminal proceedings are instituted without a legitimate basis and to ensure effective judicial review of such attempts by the Prosecutor’s office. The Committee of Ministers also urged the Azerbaijani authorities to prevent new violations of the presumption of innocence by the Prosecutor’s office and members of the government.
Leader of REAL Ilgar Mammadov was arrested because of organizing riots in Ismayilli on January 23-24 regardless of the fact that he arrived in Ismayilli region after the beginning of the riots. Human Rights Watch and Amnesty International have declared Mammadov a prisoner of conscience.
