Government to meet European court’s deadline
The European Human Rights Court, in January of this year, came to its first decision regarding the Republic of Armenia. “Mkrtchyan vs. Armenia” concluded in favor of the applicant, Armen Mkrtchyan. We remind that in 2002 Mkrtchyan was fined 500 dram for taking part in a demonstration against the government. Mkrtchyan applied to the European court, demanding under article 11 of its human rights convention (protecting the individual’s right to participate in any demonstration) that his rights were violated. The European court decided that a violation had in fact occurred.
Also, this April the court passed another decision, “Harutyunyan vs. Armenia,“ in which it declared that Harutyunyan was deprived of a fair trial. The government is obliged to pay Harutyunyan four thousand Euros for moral injury.
Recently, concerning the case, attorney Hayk Alumyan declared that the Armenian government wasn’t complying with the European court‘s decision. He added that the government isn’t translating the decision into Armenian and is doing nothing to publicize the case.
“None of this corresponds with the decision taken by the European court’s convention on human rights and the carrying-out of the decision in “Harutyunyan vs. Armenia,” Alumyan said in a declaration presented to the ministry of justice. Finally, as noted by the human rights convention, the decision should become law after three months.
In the “Harutyunyan vs. Armenia” case, in accordance with the 4th point of the article, the government is obliged to not transfer the sum and also have the case translated and published within the noted time frame. All of this needs to be done by December 28 of this year, with which the Armenian government plans to comply.
