Driver beats Traffic Police in court
Lawyer Ruzanna Azroyan exceeded the speed limit on Davtashen-Yeghvard highway by driving at 57 km/h, while the speed limit mark allows 40 km/h. She didn’t pay the fine appointed by the traffic police, moreover, she disputed the administrative act on violation and won.
The lawyer filed a lawsuit to the Administrative Court seeking to define the 40 km/h speed limit unlawful and to eliminate the fine.
Azroyan substantiated her claim by the provisions of regulations of the RA Law on traffic security. According to the law, traffic rules, road signs are approved by the government, which doesn’t have a decision on 40 km/h speed limit.
According to the lawyer, the 40 km/h on Yerevan streets is illegal. It turns out, that drivers exceeding 40 km/h speed limit have been fined illegally. She then added that newly revealed circumstances allow drivers who’ve been fined before, to demand compensation from traffic police.
The decision made by Administrative Court Judge, Karen Avetisyan, was issued on March 29. It will take a month for the decision to enter into force.
Azroyan said that Administrative Court made “an objective decision and carried out serious research”. Therefore, the traffic police will not succeed if they decide to appeal.
According to the lawyer, the lawsuit is the first in this character and the decision is unprecedented.
