Examination of Sargsyan v. Azerbaijan judgment implementation postponed at COE Committee of Ministers
Representatives of the 47 member states of the Council of Europe held their 1259th “Human Rights” meeting on 7 and 8 June at which they examined the implementation of the judgments of the European Court of Human Rights (ECHR) in keeping with the supervisory role of the Committee of Ministers, the official website of the organization reports.
At the meeting a decision was made to postpone the discussion on implementation of the ECHR judgment on cases Chiragov and others v. Armenia and Sargsyan v. Azerbaijan which were initially included on the agenda.
According to the source, Ilgar Mammadov v. Azerbaijan (Application No. 15172/13) case was discussed at the meeting.
The Committee of Ministers deeply deplored that, despite the Court’s findings on the fundamental flaws of the criminal proceedings engaged against him and notwithstanding the Committee’s repeated calls, the applicant still has not been released; The Committee recalled that “it is intolerable that, in a state subject to the rule of law, a person should continue to be deprived of his liberty on the basis of proceedings engaged, in breach of the Convention, with a view to punishing him for having criticized the government.”
The committee further insisted that the highest competent authorities of Azerbaijan take all necessary measures to ensure without further delay Ilgar Mammadov’s release.
The next meeting devoted to examining the implementation of Court judgments will be held from 20 to 22 September.
