Council of Europe decries Azerbaijan for failing to implement ECHR verdict
During the Human Rights meeting of the Committee of Ministers of the Council of Europe held on 7-9 December the representative of the 47 countries studied the process of the implementation of ECHR (European Court of Human Rights) verdicts.
During this meeting CE has again turned to the case “Ilgar Mammadov v. Azerbaijan” once more criticizing Azerbaijan for failing to implement the ECHE verdict issued on this case.
The representatives expressed grave concerns in the taken decision stating that 2 years on the issuing of the ECHR verdict and in spite of all the numerous calls made by CE Committee of Ministers and the Secretary General Azerbaijan still fails to release Mammadov who continues to be in detention.
CE restates that it is unacceptable to deprive a person from liberty in order to punish him for having criticized the government.
“Continuing to keep Ilgar Mammadov under arbitrary detention Azerbaijan makes a gross violation of Point 1 of Article 46 of the Convention,” the decision reads.
CE restates its determination to enforce the implementation of the ECHR verdict using all the available means.
CE has also expressed deep concerns regarding the fact that the Azerbaijani authorities fail to provide the necessary information on the general measures undertaken or intended to be undertaken to prevent the violations by the state authorities through exceeding the power. In this regard Azerbaijan is encouraged to engage in meaningful dialogue with the Committee of Ministers of the Council of Europe.
Notably pursuant to the final verdict issued by the ECHR Mammadov’s detention was ruled out to have political bases and it called on Azerbaijan to immediately release Ilgar Mammadov.
The supervision over the implementation of ECHE verdicts is carried out by the Committee of Ministers of the Council of Europe and the discussions in this format are held 4 times a year.
