Kocharyan’s lawyers apply to ECHR over alleged breaches of domestic law
The lawyers representing Armenia's second President Robert Kocharyan in the criminal case into the March 2008 post-election unrests in Armenia, have applied to the European Court of Human Rights (ECHR), alleging breaches of the domestic legislation.
“The complaint has been filed under Points 2 and 3 of Article 6 of the European Convention on Human Rights – violations of the presumption of innocence and the right to defense,” the lawyers said.
Kocharyan's defense team has lodged an appeal with the European Court without ending the procedure in domestic judicial instances, since the lawyers claim they are unable to provide effective remedies for the case, presenting corresponding details in the complaint.
Kocharyan is charged with overthrowing Armenia's constitutional order during the March 1-2 events in capital Yerevan. He has dismissed the charges as 'politically motivated'.
