Lawyer: Kocharyan may file an appeal to the European Court
"The first impression on the Cassation Court decision is negative. When I get the whole text, I will be able to express my opinion in more detail," Robert Kocharyan's lawyer Hayk Alumyan told reporters today following the cassation court decision.
As for Serzhik Avetisyan's opinion, Alumyan said: "As far as I understood, Mr. Avetisyan said that the constitutionality of the norms to be applied should be submitted to the Constitutional Court, and the proceedings should be suspended until the Constitutional Court m"akes a decision.”
To reporters’ question as to which norms were meant, he replied: "Probably the issues of immunity. I thought that according to Mr. Avetisyan, issues related to Robert Kocharyan's immunity are not regulated by our legislation with sufficient clarity and this issue should be submitted to the Constitutional Court. "
Another question, what the next step will be after the decision is made, and whether they might apply to the European Court, the lawyer replied: "It’s highly probable that yes."
Alumyan mentioned that the second president of Armenia personally presented his arguments during the sitting.
In response to another question that "Robert Kocharyan stated that there were video fragments on how the activists fired from behind the buses on March 1, 2008, and hid back behind the buses and whether Kocharyan submitted them," the lawyer replied. "Mr. Kocharyan has not, but I have submitted the video to the Court of Cassation today in the morning."
