Lawyers to appeal Kocharyan’s arrest ruling
The lawyers of Armenia’s second President Robert Kocharyan who was taken into custody charged with “overthrowing the constitutional order” are set to appeal the arrest ruling of the Yerevan Court of Appeals to higher instance.
As Panorama.am learnt from the defense team, the petition is based on the fact of “gross violation” of the adversarial trial principle, as the judge didn’t allow them to present their positions in the previous hearing and immediately left for the deliberation room to decide on the matter which constitutes a ‘gross violation’
To remind, the Yerevan Court of Appeals ruled on Tuesday to arrest ex-president Robert Kocharyan, granting the prosecutors’ appeals against a lower court’s decisions to release Kocharyan from custody. Judge Armen Danielyan, presiding over the high-profile trial, announced the decision in the absence of ex-president Kocharyan and the members of his defense team.
