Venice Commission agrees to provide consultative opinion on ex-President Kocharyan’s case
The Venice Commissions has agreed to provide a consultative opinion on the case involving Armenian ex-president Robert Kocharyan charged with overthrowing the constitutional order of Armenia during March 1-2 post-electoral events.
As Armenia’s Constitutional Court said in a statement on Thursday in a letter addressed to the President of the Constitutional Court Hrayr Tovmasyan, Secretary of the Venice Commission Thomas Markert informed the Commission was ready to provide an advisory opinion (amicus curiae opinion).
To remind, the Constitutional Court applied to the ECHR and the Venice Commission for a consultative opinion taking into account the appeals of Robert Kocharyan and the court of general jurisdiction of Yerevan on determining the constitutionality of Article 300.1 of the Criminal Code of the country.
Meanwhile, the European Court of Human Rights (ECHR) is yet to determine on providing an opinion over the case. As the Court said in an earlier statement, the commission of five judges would consider the case before announcing a final decision.
