Lawyer says Kocharyan should be freed ‘immediately’ if Constitutional Court accepts their arguments
Armenia’s second President Robert Kocharyan should be immediately released and criminal charges against him should be dropped if the Constitutional Court accepts all the arguments presented by his legal team, one of his lawyers Hayk Alumyan told reporters on Tuesday.
Armenia’s highest court started today considering Kocharyan’s application on determining the constitutionality of Articles 35 and 135.2 of the country’s Criminal Procedure Code.
Alumyan stressed the court is not discussing the release of the ex-president, but rather the compliance of the law applied to Kocharyan with the Constitution, as well as the constitutionality of the law in the light of the interpretations made by the courts of general jurisdiction.
Kocharyan is currently in custody pending the outcome of his trial on charges of overthrowing the constitutional order in 2008.
