‘If you show up to work unvaccinated or without negative COVID test, your employer has no right to fire you’, says Armenian lawyer
Lawyer Robert Hayrapetyan has reacted to the Armenian government decision, according to which employees will have to either be vaccinated against COVID-19 or submit the results of a PCR test every 14 days at their own expense starting from October 1.
“What to do from October 1 if your employer has asked you not to come to work unvaccinated or without a negative PCR test result? Make sure that you go to work and demand a written justification for the ban on your entry into the workplace,” he wrote on Facebook on Friday.
“If you show up to work unvaccinated or without a negative PCR test result, your employer has no right to fire you. However, if you do not go to work, complying with a verbal order or an appeal, the employer will be authorized to terminate the employment contract with you on the basis of the employee's failure to come to work throughout the entire working day (shift) for no good reason.
“Remember that no one, especially by an order of the minister, has the right to force you to get vaccinated. You can only vaccinate of your own free will,” Hayrapetyan said.
