Lawyer: Judge Boris Bakhshiyan has been illegally arrested for 44 days now
Boris Bakhshiyan, a judge of a first instance court in Armenia’s Syunik Province, has been unlawfully held in custody for 44 days now, his lawyer Yerem Sargsyan said on Wednesday.
The judge is accused of illegally arresting a defendant, Nver Mkrtchyan, in a trial presided over by him.
“1. The indictment says that Boris Bakhshiyan has illegally ordered the arrest of Nver Mkrtchyan.
2. In the motion for arrest, the prosecution noted that the objective side of the criminal act incriminated to Bakhshiyan was manifested by the delivery of an absolutely unlawful judicial act.
3. Judge Arghamanyan stated in his decision that the judicial act rendered by Bakhshiyan was legal. No one, including the investigator and the prosecutor, has the right to even question its legality.
4. The prosecutor's office has not filed an appeal in this regard.
5. Judge Arghamanyan said in a decision that Bakhshiyan acted independently, impartially and in good faith,” the lawyer wrote on Facebook.
“However, Bakhshiyan has been under arrest for 44 days now. Why?” Sargsyan said.
