Armenian top court's decision on border deal 'unconstitutional', expert says

The Constitutional Court’s decision on a recent Armenia-Azerbaijan border deal runs counter to the basic law, expert claims.

The top court ruled last week that the regulations for joint activities of the Armenian and Azerbaijani commissions dealing with the border delimitation process complied with the Armenian constitution. The Constitutional Court also implied that provisions of the Declaration of Independence contradicted the constitution and were invalid.

“The September 26 decision of the Constitutional Court is unconstitutional," constitutional law expert Gohar Meloyan wrote on Facebook on Tuesday.

"Article 168 of the constitution specifies the powers of the Constitutional Court and the legal acts the constitutionality of which it can determine.

“The Constitutional Court is not authorized to officially interpret the Declaration of Independence or comment on the validity of its provisions,” she stated.
